PROPERTY OF A MARRIAGE AND FINANCIAL ISSUES

Married people who have separated may be able to agree on how they wish to divide their property. This decision can then be formalised in a number of ways depending on the circumstances and it is recommended that an advice from a solicitor is obtained as to your alternatives in regards to property and financial matters.

You have twelve months after your divorce is finalised in which to file an application with the Family Court in relation to the division of property of the marriage. You do not need to be divorced in order to reach an agreement or seek orders through the Family Court in relation to the property of a marriage.

Other financial issues which may need to be considered after the breakdown of a marriage is whether one party is entitled to maintenance, or how the children of the marriage are to be financially maintained.
