FAMILY VIOLENCE

Sometimes, unfortunately, a relationship breakdown can also be a situation where the woman and children are suffering from domestic violence. In these circumstances, it is possible to seek orders in the Family Court of Australia at the same time as you may be seeking orders in relation to the care of the children of the relationship, which will restrain the other party from coming within a certain distance of your home or workplace, or restraining other behaviour on their part. However, the more usual way is to seek the assistance of the police who may then apply for an Apprehended Domestic Violence Order (ADVO) on your behalf, or apply for an ADVO yourself by seeking assistance from a solicitor or a chamber magistrate at a local court. An ADVO may have orders preventing your former partner from coming within a certain distance of your home or workplace, and from threatening, intimidating or abusing you. The ADVO can protect yourself and anyone else with whom you have a domestic relationship, including your children.
